Alina Habba has left her position as New Jersey's top federal prosecutor. This follows a court battle that questioned her eligibility to serve.

Official Departure

The nation's top law enforcement official, Pam Bondi, announced her stepping down on Monday. Bondi stated that the court's "flawed" ruling made it "untenable" for her to effectively run her office.

"Let no one confuse compliance for surrender," she wrote. "This battle will now extend throughout America."

Judicial Challenge

The departure follows closely on a federal appellate panel found that she had been serving in violation of the law as the top prosecutor. This judgment is expected to impact scores of legal proceedings in New Jersey.

The judicial panel said that a acting appointment that did not receive Senate approval violated the Federal Vacancies Reform Act.

Ongoing Legal Battle

It was also stated that Habba will stay on at the Department of Justice as a high-level advisor. They intend to challenge the decision of the ruling, with hopes of a reversal.

Writing online, the Attorney General argued that the court "cannot be permitted to second-guess the appointment of lawyers entrusted with executing the fundamental role of the presidency of enforcing the law."
